Abstract : The so-called 'Disputes Clause,' which is mandatory feature of all contracts with the Federal Government, precludes contractors from taking their contract disputes into court and requires instead that an administrative procedure be followed. The report analyzes the administrative disputes procedure from the viewpoint of the relatively small contractor. It concludes that the system has become so formalized and time-consuming that the small contractor usually needs to obtain professional advice to help find his way. The paper also develops the proposition that the disputes procedure is especially unsuitable for the consideration of relatively small claims (under $10,000). (Modified author abstract)
