Abstract : The Comptroller General recently observed that crime against the Government often does pay. This thesis is the first part of a two-thesis examination regarding the various statutory and administrative tools which the federal Government is now using to reverse this startling trend. This two-thesis project is intended to provide both the practicing attorney and the general contracting community with a useful primer on individual and corporate liability for various procurement-related crimes and offenses. Part One will examine four broad areas: improper/corrupt payments; conspiracy; individual and corporate criminal liability; and (4) the efficacy of existing criminal sanctions.
