Abstract : The way in which the United States goes to war has always been a puzzle. Both the President and Congress insist each has certain rights to commit troops in conflicts; the matter reaches into history to a time before the Constitution. This paper examines the powers of each branch and the rulings of the court system. Through an analysis of the War Powers Resolution of 1973, it draws conclusions about the efficacy of the government's ability to decide how to go to war.
